COST AND REQUIREMENTS

The EB-5 Immigrant Investor Program requires investments to meet strict U.S. government guidelines designed to stimulate job creation. The minimum investment amount depends on the project's location:

  • $800,000 for projects located in a Targeted Employment Area (TEA)
  • $1,050,000 for projects outside of a TEA

To qualify, the investment must be an "At-Risk" investment in a U.S. commercial enterprise, meaning there can be no guaranteed return of capital. However, this does not imply unnecessary risk—proper structuring of the EB-5 investment can help mitigate potential financial risks while ensuring compliance with program requirements.

A single EB-5 investment benefits the primary applicant, their spouse, and any unmarried children under 21, granting them eligibility for permanent Green Cards. However, investors do not receive immediate immigration benefits upon application.

The I-526 petition must first be approved, which may take over a year. Only after approval can the investor and their family proceed with immigration to the United States.

Notably, applying for EB-5 does not affect an individual’s existing U.S. legal status, such as H-1B, F-1, or B-1 visas.
