Eligibility to qualify for an EB-5 investor green card

Investment Amount

$800,000 for projects in a Targeted Employment Area (rural, high-unemployment, or infrastructure). $1,050,000 for standard projects.

Source of Funds

Capital must be lawfully earned and fully traceable from origin to investment. Acceptable sources include salary, business profits, savings, loans, inheritance, or gifts.

Job Creation

The investment must create at least 10 full-time jobs for U.S. workers, sustained for a minimum of two years.

At-Risk Capital

Funds must be genuinely at risk, with no guaranteed return.

Qualifying Investment

Capital must be placed into a qualifying new commercial enterprise, directly or through a USCIS-designated Regional Center.

Sustainment Period

Investment must remain invested for at least two years from the date the full amount is deployed.

Eligible Applicants

Open to investors of any nationality. No employer sponsorship, minimum education, or business experience required. Spouse and unmarried children under 21 are included.

Pathway to Permanent Residency

File I-526E, receive a two-year conditional green card, then file I-829 to remove conditions and secure permanent residency.
